Under the Estate Agents Act 1979 we are obliged to define the meaning of Sole Agency, Joint Agency and Multiple Agency.
Sole Agency
The vendor will be liable to pay the Fee to us in addition to any other costs or charges if at any time unconditional contracts for the sale of the property are exchanged:
• With a purchaser introduced by us during the period of our sole agency or with whom we had negotiations about the property during that period: or
• With a purchaser introduced by another agent during that period
You will also be liable to pay any other specific costs or charges agreed between us.
For these purposes the phrase “another agent” includes any other person, company, firm or organisation advertising or offering the property for sale (whether or not you agree to your property being included) including the featuring of your property on an Internet website or it’s promotion by any other electronic media or by the erection of a for sale board and the phrase “introduced by us” includes the prospective purchaser who obtains details of your property from us or via our Internet or website or by receipt from us of any other promotional material whether or not by electronic media and shall also include a purchaser who sees or is made or is made aware of a property for sale directly or indirectly via our for sale board or any of our advertising leaflets or marketing.
Joint Agency
The Vendor will have to pay the fee in addition to any other cost or charges if at any time unconditional contracts for the sale of the property are exchanged with a buyer introduced during the life of this agreement by TJS Property People or by the joint agent.
Multiple Agency
The Vendor will have to pay the fee in addition to any other cost or charges if at any time unconditional contracts for the sale of the property are exchanged with a buyer introduced during the life of this agreement by TJS Property People or with whom we had negotiations about your property during that period.
Property Misdescriptions Act
As a legal requirement of the Property Misdescriptions Act 1991 we could be fined if we give any potential buyer false or misleading information about your Property. You warrant that all information which you give to us about your property, is not false or misleading.
If you give us information which is false or misleading you will indemnify us against any losses which we may suffer or incur as a result.
For Sale Boards
TJS Property People will erect a For Sale Board on the property unless you specifically tell us not to do so. You agree not to let any other agent erect a board on the property without prior notification to TJS Property People.
Estate Agency Act 1979
The Vendor agrees to notify TJS Property People immediately if he/she becomes aware of any personal interest in the property or any connected property which any member of staff at TJS Property People may have whether or not that person is involved in the sale of the property. We are also obliged to disclose to prospective purchasers of the property whether the vendor or relative, or associate of the vendor is an Estate Agent under the meaning of the act.
We are also obliged to provide information on the services that we or any connected person, may offer to buyers. The following services may be offered: financial services, property valuation, conveyancing, letting and property management.
Payment of Fees
The Vendor agrees to instruct his/her solicitor to settle our fees on or before completion. Where all or part of the fees remain unpaid for a period of fourteen days or more you shall be liable to pay interest at a rate of 5% above the base rate for the time being above the Bank of England base rate.
Money Laundering Regulations 2004
In accordance with the Money Laundering Regulations 2004. We are obliged to obtain proof of your identity. You should provide the proof of identity as requested to comply with the Regulations. We are further obliged to report any knowledge or suspicion of money laundering to the National Criminal Intelligence Service or such other body as required by law.
Miscellaneous
We are legally obliged to inform you that TJS Property People may offer the following to potential purchasers: Estate Agency Services, Financial Services through recognised and qualified third parties, conveyancing services.
